1. Acceptance of Terms
By accessing or using the public WVU Medicine website (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please discontinue use of the Site. These Terms apply solely to the publicly accessible portions of wvumedicine.org and other informational sites operated by the West Virginia University (WVU) Health System on behalf of itself and its subsidiaries and affiliates. Separate terms apply to patient portals, mobile applications, and other secure systems. WVU Health System may modify these Terms at any time by posting the revised version on the Site. Continued use of the Site after any changes are posted constitutes acceptance of the revised Terms.
2. Scope of This Policy
These Terms govern your use of the Site, including information pages, news, and other general content. They do not apply to:
- MyWVUChart, WVU Medicine’s patient portal;
- Mobile applications published by WVU Medicine; or
- Any other WVU Medicine system that maintains separate usage terms or privacy notices.
3. Permitted Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:
- Attempt to gain unauthorized access to the Site, servers, or networks.
- Use automated systems to extract data (“scraping,” “crawling,” etc.).
- Introduce malware or disrupt the Site’s operation.
- Post or transmit material that is unlawful, threatening, or otherwise objectionable.
4. Website Forms and User Submissions
The Site includes forms that allow visitors to request information, ask questions, or provide feedback (for example, “Contact Us” or “Request an Appointment”). Information submitted through these forms is used only for the stated purpose and handled in accordance with WVU Health System’s Notice of Privacy Practices and other applicable privacy policies. You are responsible for ensuring that any information you submit is accurate and does not include protected health information unless the form specifically requests it.

WVU Health System uses limited, anonymous tracking technologies to improve website performance and understand aggregate usage. Examples include:

- Cookies and analytics tools that collect non-identifiable statistics.
No personally identifiable information or protected health information (PHI) is collected through the public Site unless voluntarily provided by a visitor through a web form. Information provided on this Site is for general educational purposes only. Your sole remedy for dissatisfaction with the Site is to stop using it.
11. Indemnification
You agree to defend, indemnify, and hold harmless WVU Health System, its subsidiaries, affiliates, and their employees and agents from and against any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be brought exclusively in the state or federal courts located in Monongalia County, West Virginia.
13. Termination
WVU Health System may suspend or terminate access to the Site at any time, with or without notice, for any reason. Upon termination, all rights granted under these Terms immediately cease.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
